SPE 11 QUALIFICATIONS OF DESIGNERS
The design of architectural, structural, mechanical, electrical, civil, or other
engineering features of the work shall be accomplished by architects or
engineers registered in a State or possession of the United States, or in Puerto
Rico or in the District of Columbia.
SPE 12 TIMELY RESPONSE
As time is of the essence, the A/E shall perform all aspects of the work on
this contract and take prompt action upon all the VA's requests. The VA
shall state a time requirement if less than 15 days otherwise 15 days shall be
the requested response time. If the scope of the required action is extensive,
the A/E shall notify the Contracting Officer and request additional time,
estimating the time needed to process the work. This request for additional
time shall not relieve the A/E of his duty to process this work in a timely
fashion.
SPE 13 OWNERSHIP OF ORIGNAL DOCUMENTS
All designs, drawings, specifications, notes, and other work developed in the
performance of this contract shall be and remain the sole property of the
Government and may be used on any other work without additional
compensation to the Architect-Engineer. With respect thereto, the
Architect-Engineer agrees not to assert any rights and not to establish any
claim under the design patent or copyright laws. The Architect-Engineer for
a period of 3 years after completion of the project agrees to furnish and
provide access to all retained materials (including electronic) on the request
of the Contracting Officer. Unless otherwise provided in this contract, the
Architect-Engineer shall have the right to retain copies all such materials
beyond such period.
SPE 14 LIABILITY
The A/E shall be responsible for all damages to property or injuries to
persons that occur as a result of his fault or negligence.
