(d) Construction Contract Not Awarded. If the Government for reasons not
related to the FAR 52.236-22 (Design Within Funding Limitations) decides not
to award the Construction Contract, the total unpaid balance including the
amount retained from any monthly payments will be paid upon delivery to and
acceptance by the Government of the original construction documents.
(e) Construction Period Services. Payments for Construction Period Services
may be made quarterly. Amounts due shall be determined by the A/E's
submittal of an estimate of the amount and value of work and services
performed by the A/E. Payments shall be the full amount due less all previous
payments and will be based upon the Contracting Officer's review of the A/E's
invoice and approval hereof. Upon satisfactory completion by the A/E of the
Construction Period Services the A/E will be paid the total payment for
Construction Period Services shown in the Schedule of Payments less all
previous payments. If the Government should not require A/E services during
the construction of the project the payments for Construction Period Services and
for Site Visits will not be made.
(f) Site Visits. (i) The Contracting Officer must specifically authorize site visits
as set forth in this agreement. The A/E shall be paid only for approved site visits.
Payments for A/E's visits to the project site during the construction period may be
made quarterly. The A/E shall keep an accurate record of all visits to the site as
described under the article entitled "Services During The Construction Period".
Each month he/she shall submit said record to the Contracting Officer for
substantiation and payment. Payments will be for the full amount due for the
billing period. (ii) The full daily rate per site visit is found in this Article SPF 1.
This rate shall apply to site visits of more than four hours. Site visits of more than
two hours up to four hours will be reimbursed at 75% of the full daily rate. Visits
of two hours or less will be reimbursed at 50% of the full daily rate.
Notwithstanding the foregoing, if the travel time from the A/E's office to the job
site is more than one and one-half hours, the A/E will be paid the full daily rate
regardless of the number of hours he/she spends at the site.
